Unengaged Couple - Division of Home

The details are that my boyfriend (at

the time) and I purchased a house in

GA in 2005. When we bought it I

made ~$35K and he made ~$120K

per year. We purchased it with a

verbal agreement that it was 25/75.

My parents provided us a loan for 5%

of the house which we are paying

back to them without interest (we

are each paying 50% of the loan).

For 3 years I have paid 25% of the

loan and claimed 25% of the interest

payments on my taxes, he has paid

and claimed 75%.

We became engaged in July 2008

and he called off the engagement in

Oct 2008. He has stated that he no

longer wishes to pay 75% that he

will only pay 50% (the house has

depreciated in value).

Question: Does the initial 25/75

stand or is he able to change it now 3

years later to 50/50 because we are

no longer engaged? I currently earn

$50K and he earns $200K, so we are

earning roughly the same percentage

as we were when we initially agreed

to the 25/75 split.

Verbal agreements as to real estate are gnereally worthless. You will badly need a lawyer and you have a mess, because as an unmarried couple you have almost no rights. Expect to pay a lot of money to untangle a mness that was preventable with one inexpensive contract.
