Legal Question in Family Law in Georgia
my wife abandoned me in july 09. she took child and went out of state. we are not legally divorced or separated. can she file taxes on child, considering she has had a part itme job at best lass than 10 days work in 5 months. can she claim eic? if she has filed as such and i have sent money supporting them and she had no real income, can she still take tax deduction? what happens if i file son and she has already filed? can i check somehow if childs ssn was used? she doesnt communicate with me. could she pass the deduction somehow to her 30+ y.o. son who lives with her? i'm recently reemployed. money low- faced foreclosure, abandonment, job loss 1 year, cc bills and cc lawsuit- low on cash for consult- what can we work out for answer.

You asked in the wrong place.
As for the tax aspects, you need to see a CPA. Unless you have paid a great deal of child support (and from your post you obviously could not have), you probably do not get the tax deduction.
As for the legal situation, the state where she now is probably has jurisidiction and you need to hire a lawyer there for the divorce. You waited too long after she left to deal with the child here, as she has been out of state six months.
