Legal Question in Family Law in Georgia

last will and testament

Hello,

1. Are any witnesses required for self-prepared last will and testament in Georgia?

2. Is it necessary to have it registered at the Probate office in Cobb County?

3. Or is it enough to have it notarized?

Thank you.

Re: last will and testament

1. No.

2. No.

3. Maybe, and the answer to that depends. There is a special type of notarization that is recommended. Anything else is useless.

It sounds like you may be trying to do something that is a very bad idea and will likely mess things up for your heirs and cost them lots of money to fix - writing your own will.

Since you can have it done right by a lawyer for as little as $150, there is no reason to mess things up for your heirs. Call my office and I'd be glad to assist you.

Re: last will and testament

Your heirs will often pay the price for errors in procedure and drafting will documents. Most individuals do not try to repair a furnace or television themselves, because they sense that they do not understand everything that is involved. Writing a will is no different and the self help vehicles available lack the tailor-made, comprehensive approach that is necessary.

My office can offer you affordable assistance that is provided by an attorney, rather than a paralegal. Please do not hesitate to call upon my firm if you are not already working with someone.

Re: last will and testament

It is obvious you are trying to do something you know nothing about. My concern is that there may be other issues in whatever you have prepared that you haven't asked about. Consult with a local attorney. If your estate is worth more than $250.00 (two hundred fifty dollars) paying a lawyer may be money well spent.
