X husband moves out of the country

My X husband and father of 7 year old son just told me he is moving to Germany in a few days. He is not moving there for work (he was laid off a week ago) He told me that by law he does not have to pay court ordered child support. I was wondering if this was true.

He has visitation every weekend, and says he will come back to Georgia 1-2 times a year. If he comes back in a year (while not paying child support) Do I have to let my son visit him?

Visitation is not dependent on child support. Why would you punish your child for his non-support? Additionally, why would you risk the wrath of a judge you may need to enforce your support rights? You have no more right to violate the court order than he has.

As for support, Germany sometimes is of help with American support orders. Your county DA may be familiar with this and be able to help, or you may be able to find counsel in Germany to assist with support. Additionally, if you take out a criminal warrant (for abandonment) here, he can be arrested when he returns to the U.S.
