Legal Question in Medical Leave in Georgia

Reduction in raise due to my maternity leave

I would like to know what legal action, if any, I have against my employer. My manager informed me that the raise value that he reccomended for me was not approved by corporate because I was "out for three months this year" for my maternity leave. Doesn't the family medical leave act protect me from being penalized for this?

Re: Reduction in raise due to my maternity leave

It depends. If the raise was an annual raise given to all employees, the raise should be given to an employee out on FMLA leave, in most cases. If it was a performance based raise, they may have been legally authorized to deny the raise. There are a number of factors that go into this determination, and you might want to check with an attorney to be sure.

The foregoing is general information only, not specific legal advice. No attorney/client relaitonship has been created or should be implied. Check with an attorney of your choosing before taking legal action.
