Legal Question in Medical Leave in Georgia

i was taken out of work on Oct 12 for a brain anuersym but my surgery wasn't till Dec.22.My employer is telling me if I have not been released fully by Feb. 2 then I must take a years leave and lose all my benifiets. My final check up with my surgeon isn't till Feb.3. Can they terminate my health and other benifits like this.

If the FMLA applies (you don't post enough to conclude this), you have 12 weeks of unpaid leave. Beyond that, there is no general right or entitlement for employment, or that an employer keeps a job open for someone not there to do the work.
