if accident claim exceeds auto insurance limits

My son in law was in an accident and ran a stop sign. Other person's car was injured but person said she was fine. Now she has collected maximum insurance benefits. My son in law has no house or car---what would a court be likely to award in a situation of poverty like this?

Your question is unanswerable as posted. We have not seen the police report, the medical evidence, or the claims file. His wealth has nothing to do with the damages. A judgment can (1) get his license suspended, even for life, until paid or discharged in bankruptcy, and (2) can be collected in the future by things like garnishment.

When he is sued, he needs to hire a lawyer immediately, as he must answer within 30 days.
