Legal Question in Civil Litigation in Georgia
Do I have to have an active Court case to be able to subpoena records from a phone converstation that I was included on? If so what should I file it it under?

Generally yes. Lawsuits require, at minimum, facts, a cause of action and damages. Since you have provided none of these, it is not possible to even speculate what you would "file it under."
