auto accident - at fault driver a minor

I was involved in an auto accident.I was hit in the rear by a 17 year old driver while stopped at a traffic light.no one was injured. He was cited for following too closely. The car was owned by his step-father. After many weeks of calls to his insurance company, I was told he (the 17 year old driver) wasn't covered to drive that vehicle. The damage to my vehicle is $2800.

I am thinking of sueing him in small claims court but don't know if I should sue him (the driver being a minor), the step-father or both.

Assuming the driver lived in the step-father's household, I would sue them both.
