Legal Question in Civil Litigation in Georgia
Auto accident 18 wheeler
I was hit by an 18 wheeler last friday. I was not injured, truck pretty banged up though. The driver of the 18 wheeler had 2/3 of his windshield covered with window tint. I feel like the trucking company put my life in danger by allowing this window to be tinted, and according to state law having the windshield tinted is illegal. Does it sound like i have grounds for a lawsuit because the company allowed this, and therefore put my life and everyone elses life on the road in danger? If so, how should i go about telling an attorney that i want to sue the company for this?

Exactly how did the tint lead to the accident? You don't get to sue merely because you think someone is driving with a dangerous condition, if that has nothing to do with the accident. You also don't get to sue for what you believe MAY have happened (ie, the "life in danger" line). You failed to state who was at fault as far as the police report, which is very important. You also state that you were not injured. What do you expect? IF the other driver is at fault, you have a claim for the damage to the truck (whatever that may be). Generally, you don't get a big payday for an accident with some property damage because you think the accident could have been worse, or because someone ELSE could have been injured.

You don't have a case other than a claim for the damage to your truck, and even that is assuming the other driver was at fault. Since you weren't injured, you have no claim for a hypothetical injury which, thankfully, did not occur.
