My Ex Babysitter is taking me to small claims court!
My ex babysitter is taking me to small claims coust. She clkaims that I owe her 2 weeks pay for services she did not render. I had a contaract w/her that stated I that 2 weeks notice must be given to terminate contract. It does not state must be written. My reasoning for terminating the agreement was becasue I feared for my daughers safty as well as she was not adequately providing services. She called me several times to state that she wlde not be available or her kids were sick. She was also wathcing like 10 kids by herself and lied to me. Also onme night she had my dghter till 10 pm and was unreachable. Her cell phone was turned off and she was not where she sd she wld be!! I am wondering what I should do and can i counter sue her. Does she really have a case against me. When she called me to try to get money she stated that shes done this several times before.

You can show up and tell your side to the Judge, or pay a lawyer for an hour or so to review the facts, or go with you. You fail to state relevant facts (such as what notice was provided, and by whom) for anyone here to provide a meaningful opinion and no one here has the contract. You ask if you should counter-claim, but you do not provide any facts showing what claim you might have. The day-to-day details about why you were not happy with her are likely not relevant. If there is a dispute about notice, or you cannot prove your case, you can decide to risk a judgment or settle it. In the future, handle such things in writing. If it was important enough to do a contract in writing (which is not clear from your post), then it is important to handle all subsequent matters in writing.
