bathroom remodel contract
What options do I have concerning a bathroom remodel contract that was supposed to take 2 weeks, but ended up taking 10 weeks, and the job is still not complete. The contractor took other jobs in between my remodel, and many days did not show up. There is no where in the contract that states we can deduct for going over the 2 week time limit. However the contractor had someone helping him that had to tear out some of his carpentry work, and stated it was unacceptable while that contractor took another job putting up a privacy fence for someone. The job price was supposed to be $5,925. The payments were split up as $1777.50 prior to beginning work, $1777.50 upon completion of Demolition, and $1777.50 upon completion of all work, finally $592.50 quality assurance period, 1 week after completion. So far we have paid him the first two $1777.50. The job began on May 6, 2008, and ended July 18, 2008. He said he was done, but there are a list of things he still needs to finish, however we do not want him back in our house.

Assuming the contractor agreed to finish the job with two weeks, you would potentially have a claim for breach of contract. And unless the agreement states a set amount of damages, you could claim the damages stemming form the delay. If the job is incomplete, you could hire another contractor to finish and then seek compensation form the original contractor for the reasonable cost of having to finish the job.
