Legal Question in Civil Litigation in Georgia
breeders rights
I bred my dog to a friends male. we verbally agreed that the stud fee would be 1 puppy. Now that the puppies are here he is demanding 2 puppies or a $400 stud fee. We never discussed $400 or two puppies before breeding only one otherwise I would have never used his male. He is now threatening to take me to court. What does the law say about this agreement?

Re: breeders rights
I would tell him to go fly a kite. I used to breed dogs and I believe it is standard for the owner of the stud to get one puppy. If the matter goes to court, you should bring along another breeder who can testify to that. Also, although it would have been better to have had the agreement in writing, a verbal agreement is enforceable. If anyone such as your spouse or a friend overheard the agreement, he/she can testify to that. I would send him a certified letter restating your side of the agreement and give him until the weaning date or so to pick his ONE puppy; otherwise you are going to sell all of them.
