Legal Question in Civil Litigation in Georgia
car accident
I was in a small car accident at a car wash and someone hit me in the back at the car was. There an incident report and the driver admitted to hitting my car. He said he would take care of all expenses. I spoke to him several times since the incident and faxed him the estimate to get my car fixed, but I have not heard from him since. I have all his information address, insurance, work, etc. I would like to send a certifited letter to his house to let him know I may have to take legal action concerning this matter. Please let me know how I should handle this situation from here.
Thank you,
Ms. Slay

Re: car accident
Go ahead and send the certified letter. In the meantime, go to the small claims court clerk's office in the county where HE lives (that's where you will need to file if it comes to that) and get them to explain the procedure.
Re: car accident
Depending on the damages amount, I would recommend retaining an attorney to at least write and send the letter for you. You other option would be to file a claim in magistrate (small claims) court, as long as you would not be asking for more than $15,000.
