car titles

we purchased a car from someone through another person whom we trusted. he was to hold the title until we paid the balance of the car. once we paid the balance and thought we were getting the title it was signed over to the person whom was suoose to be holding the title. now we are having a hard time getting this person to return our calls. we have insurance on the car. so now that its in the others name it needs to be rgistered in his name then signed over to my daughter. its been several weeks we are worried about getting pulled over the car being taken etc. this person doesn't return calls, his wife has told him several times that we need him to contact us. dont have money to sue. dont know what else to do. have a message on the phone from him about the puchaes of the car from the beginning. what can we do?

You've probably been swindled by a criminal, so you may want to simply swear out a criminal warrant.

Your other two options are to hire a lawyer and sue, which will cost a lot, or sue the person in small claims court. It sounds like you don't even have a bill of sale, so you may have a tough time, as you don't buy cars with a phone call and no paperwork.

Cars are not sold with people "holding titles." A proper way to sell the car gives you the title and they are listed as lienholder. For futire reference that is the only way to finance a car.
