You should consult with a local attorney because your question doesn't make sense. A trademake is not a legal entitiy. Therefore, the company cannot transfer a lawsuit to a trademark. As I said, a traidmark is not a legal entity and therefore can't sue anyone. I think you may have your legal entities confused and, like I said, you should consult with a local attorney who can review all of the facts of your situation.

A trademark is a device (usually a phrase or logo) pointing distinctly to the origin or ownership of a service or good. It is not an entity itself.
