Legal Question in Civil Litigation in Georgia

Default Judgement Civil Action Suit

An auto sales company filed a civil action suit against me in '99 for a rvehicle that they repossesed during the same year. They garnished my wages for a short period of time in '01, and stopped because I switched jobs.

I recently found out that they are still trying to pursue me, however the debt is about 8 years old. Because the debt is so old, do they still have the right to sue me?

If they garnished your wages, they already sued you and obtained a judgment against you, so your question does not make sense. They can attempt to collect on the renewable judgment for many years to come.

Re: Default Judgement Civil Action Suit

You lost the case. A judgment entered in the State of Georgia is generally enforceable for period of seven (7) years, and may be renewed by an action or by scire facias, at the option of the holder of the judgment, within three years from the time it becomes dormant. If renewed, the judgment remains collectable now.
