The difference between summary judgement and frivilous?

We lost a case on summary judgement -not enough material fact. so is this the same as ''Frivilous''? my cousin is going to sue to get me to pay his attorneys fees. He also says we did him harm? what about the harm he has done us? can we countersue?

These are questions for the lawyer who handled the case for you, not a forum of people who know nothing about your case. If you did not have a lawyer, it should be pretty good evidence of why you need one.
