Legal Question in Civil Litigation in Georgia

Due to a rusted pipe issue the rental property that I resided in for two years flooded (twice) and my family had to move incurring unexpected moving, property damage, and non-econimic expenses. A local Hospital was responsible for the rusted pipe issue, and I contacted the hospital in regards to compensation for my loss. The CFO contacted me and advised me to email him a letter of my expenses and the damages. Should I also include expenses from the days I took off from work?

You can ask for anything you want. They can then offer whatever they want. You might expect actual moving expense, and actual damage to your property - not your time, etc.

First of all, you don't do this in email. You want a paper trail. Think paper letters. Certified mail. Do it right. (If the amount is large, see a lawyer).

You can ask for what you want and they can offer what they want. Actual damages to your property and actual moving expenses are compensable. As a general rule, time is not. You can ask, but they may not agree.

Scott and Glem are absolutely right, however, any damage to the leasehold goes to owner.

Keep good records and a clear paper trail (to whom you communicated, how, when, content of communications -- i.e., copies of letters, emails, tweets, etc.).

Any and all future correspondence should be my CertMail, RRR - but do not make an offer for settlement until and unless you have gathered all of your evidence of damages (excluding any loss from work) and OLNY AFTER you have consulted with an attorney in your area.

You really need to consult with an attorney ASAP

Call me and I am quite sure that I can find you a good attorney in the Augusta area who is conversant in the areas of law in which your query covers.

Good luck and have a safe and Blessed Labor Day Holiday (what's left of it)

Regards,

Ralph

The above is not meant to be legal advice or a contract for legal services; you must consult with your own attorney after you have given him/her ALL of the facts and documents and records relating to and concerning these issues
