Legal Question in Civil Litigation in Georgia

Failure to satisfy lien payment by collection attorney

I had debt that I did pay off last year after judgement. Upon pay off the debt I requested the collections attorney to wirite the FIFA letter confirming that that the debt had been satisfied.

The collection attorney failed to heed my request as a result of the same I have had the mortgage company decline to refinance my house because the lien is still showing as ''live'' and attached to my property and yet I have written confirmation from both the debtor and attorney that the very same debt was paid off.

What are my right under the situation?. Can I sue the attorney and the debtor company for the highter interest I will have to pay because the low rate I had ''locked in'' expired and I have to go back in the market and shop for a new rate?

I leave in the state of Georgia

Thank you

Re: Failure to satisfy lien payment by collection attorney

Based on what you have stated, you may well have a case against the attorney. However, I would not be willing to suggest that you proceed in that direction without reviewing all the documents, correspondence, etc. You should consult with a local attorney.
