Legal Question in Civil Litigation in Georgia

Is this fair.

I was injured on the job.Had to file bankruptcy due to finacial difficultys.I filed a personal injury suit against this company.Four years latter they filed for summary judgement on the grounds that i did not put them on my bankruptcy petition.Before this claim was filed i payed off the bankruptcy.Was it fair for the judge to give them thier summary judgement.The bankrutcy judges dicision was before the civil judge before he made a this decision?

It is fairly common for defense attorneys to argue that there are no damages when a plaintiff fails to list a personal injury claim in bankruptcy schedules, and it often acts as a defense to damages.
