Legal Question in Civil Litigation in Georgia
False Allegations of dog bite
I have a very gentle dog that has never bitten anyone. A neighbor called animal control stating that my dog bit him. This is impossible since George has NEVER been out without being on his leash.
Animal control has George in quarantine right now, but he will get out in two days.
How should I counter the claims that this neighbor has made? I have other neighbors who could testify that George has never run loose.
I think he's doing this since his dog attacked my dog a few months ago and I contacted animal control. He was found guilty of letting his dog run loose and was fined. This neighbor said he is going through rabies shots, and wants me to pay for them! George has had all of his shots. I think a different dog bit the guy, so he is getting the shots to be safe, and just decided to blame George to get even for the earlier incident. In his complaint, his description of my dog is not close to describing George. He said that it was a 120 pound Doberman/Rottie, and George is a 50 pound mixed breed who looks like a shepherd.
I'm worried that the neighbor will sue me for damages!! I'd take responsibility if it happened, but George is innocent!

Re: False Allegations of dog bite
I'd take my chances and let him sue. You can then counterclaim for any damages you sustained and subpoena your neighbors to court. Or, you could take the initiative and sue him. You should consult with a local attorney.
