Legal Question in Civil Litigation in Georgia
I filed a Statement of Claims and a Sheriff's Entry of Service in Clayton County Georgia's Magistrate's Court. If I am unable to be in town the date of the hearing can I have someone attend in my place or do I need an Atty.? This concerns a contract to privately finance a used truck, of which I provided the financing for $5000 at the rate of $200/month. The man made about 800 dollars in payments and now totaled the truck and claimed the insurance money falsely, though I hold the title showing me as the lien holder. The insurance fraud division has forwarded the case to the GA DOR auto crimes unit to determine if Title fraud has been committed. So if i am out of town can a friend stand in for me in court?

No. If you file a case in court and choose not to attend, your case will be dismissed for want of prosecution. A friend can't represent you, and while a lawyer can, the lawyer can't testify in your place.
