Final paycheck withheld

My employer has held my final paycheck from 8/15/06 despite many phone calls and emails requesting it. I have filed a small claims suit against them. Now they are wanting to pay up but they want to deduct the cost of lost property from my check. Can they legally do this?

We do not know the details of this "lost property." However, if they have a claim against you, they can probably assert it in a counterclaim and ask the court to deduct the amount. If you owe them for something, resolve it before going to court.
