Fired while in the hospital

I was fired while in the hospital recovering from heart surgery. Reason given was that i could no longer do my job. My termination notice gave one date but the date they gave my insurance co. was 4 days earlier. My insurance co. is now saying they won't pay my medical bills. When I received my last paycheck they had taken out full premium. I am almost retirement age and am having a hard time finding work, now I am faced with possible bankruptcy. Do I have a case against this company for fraud or anything? All I want is my medical bills paid..

Sherry and Scott have good advice for you. You should seek an attorney's advice. Prior to opening my own practice I worked for a company that pursued insurance companies, employers and other third party payers for hospitals when they belived that a patient's claim was wrongfully denied. I have seen situations such as yours many times. I do not want to frighten you but you face a very limited period of time to act.

There is usually not a reason to be overly paranoid about not mentioning the situation with anyone. You simply need to make sure you don't sign anything, and watch what you say to the company, lawyers or insurance company. Many such matters could not be resolved without paying a lawyer if one could not speak about it. If/when you see an attorney, make sure they specialize in this area of law. It is not a case for lawyers who claim to do anything and everything. A qualified lawyer may be able to resolve it much more promptly.
