Legal Question in Civil Litigation in Georgia

GA Statute re: Countersuit

GA Rules of Civil Procedure allows a countersuit to be filed with the defendant's answer, but 9-11-12 states the countersuit ''automatically stands denied''. What does that mean exactly? Why allow a countersuit to be filed, if it is going to be automatically denied?

Re: GA Statute re: Countersuit

All that means is that the Plaintiff does not have to file an answer (it is presumed that the Plaintiff disagrees with you). The court still has to decide the case.

Re: GA Statute re: Countersuit

It doesn't mean that the claim is automatically rejected. It means that the Plaintiff does not have to respond to it specifically and that all the allegations are deemed denied by the Plaintiff, not the court.
