The guy I'm suing is married - should I include his wife in the lawsuit

I hired a non-incorporated contracting company (husband & wife) to finish my basement. They did not finish the job but were paid some monies in advance. I plan to file a small claims suit. Only the husband signed the contract/estimate. Checks were written to both or either the husband or wife. I want to have access to property that is likely in both of their names. Does it matter? If I include only his name, can I still put a lien on property that is is both of their names? THANKS! Your assistance is greatly appreciated.

You would be able to attach any property that has his name on it, but you should definitely include the wife in the suit in case there are assets that the husband does not own. I strongly recommend you speak to a local attorney before pursuing the claim.
