Legal Question in Civil Litigation in Georgia
Helped friends out, but waiting to get paid back...
One of my family members, thinking more about helping friends in a time of need, had offered loans to several families who needed money to pay off bills and mortgages or go into bakruptcy.... Total is 15K for both loans. Some of payments have been received, but we are at the point where we need the money to be paid back, or on a more frequent schedule. Unfortunately, there were no promissory notes in place. Do we have any legal recourse to recover the funds?

Yes, you can file a lawsuit to recover the funds. However, you will be hampered buy the lack of a promissory note. Consult with a local attorney.

You may pursue a civil claim in order to recover amounts not paid. You would have a much stronger case with a written agreement (promissory note) because they may deny owing the money.
