Legal Question in Civil Litigation in Georgia

Hunting dog damages auto in accident

My husband hit and killed a hunting dog that darted out in front of his truck on a busy highway. There are damages to his truck. The hunting dog owner says he doesn't have to pay what our insurance company will not cover because this was like hitting a deer or other wild animal. ''Act of God or nature'' kind of thing. Is the dog owner correct?

Re: Hunting dog damages auto in accident

Several years ago I handled a case where a cow got loose from its pasture through a broken fence and was struck by my client. We obtained a satisfactory settlement.

You must prove that the owner of the dog was negligent in some regard in letting the dog roam loose wherein you hit it.

However, the economics of such a claim would likely preclude involvement by an attorney.
