Legal Question in Civil Litigation in Georgia
An in-law of mine took out a loan and purchased me a car. I agreed to make the payments of $130.94 every month. I was told that the payment was due on the first of every month and late after the tenth. I have made every payment by the tenth and will be paid off this January. Due to the economy, my husband and I have had a rough time, but have managed to make the payments before they were late until this past September. I told her that I would catch it up as soon as I could. We are now able to catch it up this month, but she wants to sue me for $20,000 although she's paid the loan off and is holding the title, not the bank. Can she sue me like she claims she will?

What does your written agreement with her say? (You can't do this without a written agreement since contracts for more than $500 must be written). Your agreement will spell out what is default and what remedies she and you have.
