Legal Question in Civil Litigation in Georgia

I live in Douglasville Georgia, I was dating this guy and we drew up a contract which agreed that he would pay my car loan (not a lease) make monthly payments and pay off in full 37k when he received a limp sum that he was supposed to be recieving, well 3 months have passed he is no longer employed, he never received the lump sum. we are no longer a couple I am in the process of filing a chapter 13 and I need my car back.

I was told that I needed to file a civil case

You need to NOT file anything and talk to your Chapter 13 lawyer. Your potential claim is an asset of the estate you must report, and you probably need permission of the bankruptcy court and trustee to pursue it. You likely need a customized Chapter 13 plan taht will not be a form plan. This is NOT a do-it-yourself project. Get a very experienced Chapter 13 lawyer. This is not close to a simple matter.
