Legal Question in Civil Litigation in Georgia

I live in Georgia and I was involved in a car wreck September 10, 2010 that has parties total involved. One of the parties insurance company happens to be GEICO. My insurance paid out the max coverage that I paid for at the time. Now exactly 2 years later I am given papers stating that GEICO is suing me for $5,000.00 plus all their legal fees. They claim that my $25,000 bodily injury coverage did not completely cover the other party. I am a single mother with is only a teachers assistant making not even $13,000 a year at an elementary school and do not even own my own house and has had to take out credit cards to help get gas to just get to work and I'm also pregnant and Due in December which means I'll be stretching my pennies even further. I cannot afford to pay these people that's why I had car insurance was to help avoid situations as the such. Please any Help or advice would be greatly appreciated. - Danielle

Actually you made a very poor decision in 2010, and by trying to save a few dollars a month, it will be very costly now.

No one should ever buy just minimum coverage, as it leaves you vulnerable. Higher coverages don't cost a lot more, but they help avoid your situation.

Since you didn't buy enough insurance, you are being sued now. Be aware that when you lose they can garnishee your pay and bank accounts and also suspend your drivers license.

Your usual options now - work out a settlement and pay them, or go bankrupt. be sure to see an attorney before your 30 days to answer expires.
