Legal Question in Civil Litigation in Georgia

Malicious Intent in termination

I would like to know can an employee sue a former employer for firing that person due to malicious intent? This person had perfect reviews, however her boss treated her terribly. Promised her a raise after she took on a co-workers job, and when she complained about what was going on to the guy who was over staff, she was fired. There's nothing right about the situation. Is there anything she or I can do? We have been told that the group isn't covered under Federal law bec. it has less than 15 persons on payroll and also the organization apart of a church. There has to been some recourse.

Re: Malicious Intent in termination

I doubt that you have much recourse, but it wouldn't hurt to have the entire situation reviewed. Consult with a local attorney.

Re: Malicious Intent in termination

Most employment in Georgia is "at will," and an employee can be terminated for any reason or no reason (with very few exceptions involving certain discrimination), and employes have the same freedom to quit a job. Whether or not it is "malicious" is meaningless, absent an actual wrongful act. There is no general "right" to a job, so I am not sure what "recourse" you believe is there.
