Motorcycle Sale

I sold a motorcycle back in May 2005.He gave me a check for 9850.00 on a Friday but then asked me to hold the check until the next Monday & I agreed to do so. At that time he then asked to make payment arangements and I was willing to work with him. Since then he has given me 1500.00. There was no signed contract between the two us due to the fact that he was a friend of my wife.He has not paid anything else on the bike and will not bring the bike back. The motorcycle is still financed in my name at a credit union and I'm still making payments. I need to know what I need to do to get this bike back in my posession. He refuses to bring the bike back and will not pay the bike off. Thank you for any help in this matter.

Since you agreed to hold the check, by law, you have extended him credit. He has no obligation for the payments to the holder of the loan, but he does have an obligation to you. You should continue to make the payments to protect your credit and immediately sue him in small claims court.
