non payment for job performed

My mom worked as live-in babysitter for this family for 28 days and they refused to pay her for the time. Could my mom sue these people for payment.

Yes, she can file a lawsuit. However, you state nothing about any agreement they had, or the other person's side. Those issues dictate whether she will prevail in the suit.

There are several options open to your mother, one of which is to pay an attorney to put the individuals on notice of the actions that will be taken against them in the event that they do not pay your mother.
