Orthodontist refuses to finish treament

I had braces put on 11/2004 for spaces. I paid $3,700 for top & Bottom braces, Only the top were placed. Treatment was to be finished in 12 months. 13 Months later In 12/2005 I moved to NY. I missed 11 months of treatment. I moved back in 11/2006 & cont. treatment. In Aug 2007 he said I needed my cavities filled. in-order 2 cont. treatment. In 4/2008 I returned without my cavities filled. He said my gaps r not going 2 close,& said my bottom teeth did not need braces. My Braces did not get removed. I spoke 2 another ortho who said he could do the work. I returned 2 Dr. M for a refund, he refused. I requested my medical records b/c i was going 2 speak 2 an attorney. I got a voicemail saying 2 come in so he can place my lower braces and close my gaps,I said no. I then agreed 2 speak 2 them. Dr. M asked me 2 sign an agreement stating that I will waive any claims against him. In return he would refund me $1,050. I Refused. I agreed to continue treatment since it would only be 9 month to complete the treatment. 3 Days before my appt. his assistant called me and said that Dr. M does not want to work with me and he will refund me $1,050 & refer me to another Ortho. Can i get a full refund since he can do the work, he just doesnt want 2?

We only have one side of the story, and even that indicates there is more to the story. No one here can tell you if you are entitled to a full refund, or any refund, based on your post and the other facts not stated. Negotiate a reasonable refund you can live with, and move on. It is not likely worth a legal battle.
