Payed for car to be fixed and job isnt done

My husband and i payed a guy to put a transmission in our vehicle. It's been about a month in a half and our vehicle is'nt finished yet. Can we take him to court and sue him for our money back. Although we are not nsure if he had a license. We just knew that he was a machanic. And if we can sue how do we go about that, through the court system.

Of course you can sue him. Contact your local magistrate court.
