Legal Question in Civil Litigation in Georgia
PERSONAL PROPERTY DAMAGE
My neighbor has damaged my chain link fence that runs parallel to her driveway several times causing it to lean toward our property. The fence separates our property from hers. It seems that she has done this by hitting it with her car. What recourse do we have. We are not on speaking terms with her, she is a difficult person to deal with.

Property Damage Question
There are a couple of things that one needs to know before discussing your legal options. 1) Is the fence on your property? 2) Do you have proof that it was in fact your neighbor that ran her car into your fence?
If those questions can be answered affirmatively, then you have a claim for damages against your neighbor. This can be done through a claim on her auto or home-owners policy; however, this seems unlikely since you and your neighbor are not on speaking terms and she is unlikely to give you her insurance info. Your other option is to file suit against her in Magistrate (Small Claims) Court in your county of residence.
To be able to answer your questions fully, I will need to speak with you and get the entire story. Feel free to call my office if I can be of any further assistance.
Sincerely yours,Alex Simanovsky
