Legal Question in Civil Litigation in Georgia
Personal property dispute
Boyfriend gave $700 ring to me for Christmas. I did not ask for a ring, pick out the ring, or even know until after the fact it was a financed purchase. We have since broken up and he is now telling the that the jewelry store has told him the ring belongs to him because he is paying for it and I'm not. Tonight he's been texting me and saying he would ''call the law'' tomorrow if I don't give the ring back to him. This was NOT an engagement ring, it was a Christmas present. I'm 18, he's 20. I have no idea if I should be worried about his threats. What, if anything, can he do to me? Am I wrong to believe the ring is mine since it was a gift? Thank you so much for your help.

Re: Personal property dispute
As long as the ring was given to you as a gift without any kind of condition attached (unlike an engagement ring), it is yours.

Re: Personal property dispute
The fact that the jewelry store is getting involved indicates that they have a security interest in the item. That is an issue, gift or not. If a lender has a proper security interest, it generally cannot be defeated just because someone gave away the item. The boyfriend can only give you what he has to give, and if that is a ring with a security interest attached, you might have a problem. Work it out with the boyfriend, and the jeweler.
