If the injured person has a viable claim, it would be against the property owner. The owner might then have a claim for breach of duty against the person who made poor decisions on their behalf - such as failing to maintain the appropriate insurance. If someone is unable or unwilling to exercise good judgment and handle the affairs of an elderly person, they should let someone else handle it.
