Legal Question in Civil Litigation in Georgia
I purchased a small prefab cabin from a company that I recently had delivered. Not even 2 weeks later I noticed a lot of cracks in the wood used to build the house on the inside. I asked my contractor to take a look so he started doing more digging and did a visual inspection below the building and found that the integrity of the structure was compromised. There are many big notches on the support beams, very low quality scrap wood and what appears to be mold on several piers. There are also a few other things as well, one being that the building was dangerously unlevel (which was also their responsibility upon delivery). The company has a "warranty" and said they would repair everything however it would be impossible to repair without rebuilding not to mention I don't trust them at all. After doing some research after the fact, I found out that this has happened to others. I asked them to either send me a new building or for them to pick up the building and I would like a refund for my deposit. They refused both. My question is, if I take them to court do I have a claim to get my deposit back since I technically did not give them a chance to repair these things. Any advice is greatly appreciated!

A lawyer would have to read the warranty to answer but if you refuse to let them attempt repairs you probably don't have a remedy.
