Legal Question in Civil Litigation in Georgia

i put a ring on consignment at a jewelry store 5 years and one month ago.went to get it a week ago and the store had lost it.i have a signed agreement that the ring will be returned or i get $1000. the store is not being operative. can i take this to small claims court? is there a problem with it being 5 years. the contract has no time limit on it. thanks gary

The Georgia statute of limitations for breach of written contract claims is six years. So you should be able to sue.
