Legal Question in Civil Litigation in Georgia

I rented an apartment to someone who wrote a bogus check on a closed account. Do I have to go through a formal eviction or can I go to law enforcement right away since they committed check fraud. I live in Georgia

Those are two separate issues, not either/or. If you want to evict, you file a dispossessory. If you want to pursue criminal charges, you can do that too.

Yes. The criminal action does not relieve the landlord of having to go through the formal eviction process. However, if the tenant moves out voluntarily, that you would obviously not need to.

You have to do both - evict the tenant with a disposseory and do the bad check case separately. In most counties both can be done in the same court - Magistrates Court.
