settlement

If you have reached a settlement with the defendants but have not been paided, does that make the confidentiality of the suit and settlement not binding. Sine nothing has been exchanged, no money would mean no agreement wouldn't it?

Possibly, if the other party has materially breach the agreement. The suit itself is probably not confidential, but maybe some documents or information exchanged via discovery, if any.
