Legal Question in Civil Litigation in Georgia

Small Claims

My Case was settled in front of a judge and I was awarded $1000(orig. claim was $3000 and the judge didn't agree with the claim amount)for the damage. During the settlement process, I told the judge I will hire someone to fix the damage with the entire $1000. Now I am thinking about hiring someone else for less than $1,000. The defendent indicates to me that he will bring a lawsuit if I hire someone else for less and that I was trying to fraud the defendent.

My question is can a defendent bring a lawsuit just because I decided not to spend the money for repair?

I am still responsible for the repair in the future.

Your expert advice is greatly appreciated!

Re: Small Claims

A defendant has no say so as to how you spend the money (or even if you do).
