small claims to superior court

after handling my daughter's case in small claims court, which we won, the defendant has elected to appeal the case. Do we need an attorney to represent her in Superior Court and can we recoup the losses (charges) if we win there also? He is represented (and has been) by an attorney.

You may be able to recover court costs and attorneys fees depending on the nature of the case, contract terms, conduct of the other party, etc. While it is never required that an individual be represented by an attorney, it is never a good idea to proceed in state or superior court without one, especially if the other party is represented.

In the first place, you will not be able to represent your daughter in Superior Court unless you are an attorney. If she (or you) decides to hire an attorney to represent her, you may be able to recover attorneys fees, but that is not a sure thing. Consult with a local attorney.
