Legal Question in Civil Litigation in Georgia

I had to get a TPO on my ex-girlfriend and while in court she told the judge, that while she was incarcerated her brother and sister came to the apartment that we both shared at the time and retrieved my clothes to give to me. I have not received them yet. I want to know what is the best option for me to take to get my belongings back?

Hire a Georgia attorney. He can write a letter to the brother and sister demanding return of the items. If the items are not returned, he can file a lawsuit. You will need to make a specific list of the items that were taken and have proof that those items are yours (receipts, bank statements, etc.). Best of luck.

Unfortunately you asked AFTER the hearing and not before, so depending on what the order says, you may or may not be able to do what Phillip says. The next case you file in court, see a lawyer first. At this point you have to have a lawyer review the case and see if you can undo what already happened, which may or may not be possible.

Contact local sheriff and show him order and have deputy accompany you to location of your items. If they refuse to turn them over (sheriff's deputy will be a witness) file and application for theft by taking against both of them (and your ex-girfriend if she is involved, too) and have them arrested or agree in front of judge to turn them over within 24 hours (not damaged, etc) or return to court the next day, have the warrant issued and go to Jail.

Best to consult with a good attorney FIRST (Phil, Glen or I may be able to help, call us)

Good luck
