If a Home owners Association peers over a fence and takes pictures of your back yard for evidence in a DRC dispute, can this be considered trespass? Can a Tort be Filed?

No more than if you took pictures in your front yard, and you happened to include someone else's property in the picture. Moreover, it is not trespass merely because someone comes on your property.
