Vehicle hits stationary object

At our local drive thru last thursday, my car hit a metal/concrete post. I know this is never anyone elses fault...however...this store has been here for many years. In an effort to compete with the other guys, they installed a ''pay'' window without any changes to the grade, curve or slope of the driveway. this created an impossible turn to get to the pay window. This company initially had no post, and customers kept hitting the brick building. On those occassions, the company was quick to call the police and get paid for their bricks. There is no warning sign that there is an unusual turn ahead. Do I have a case and how can I prove it? Damage was $650 plus rental car. Owner and insurance adjuster have declined to talk with me further stating that it--name removed--just my fault. Is it?

Yes. You are responsibel ofr your vehicle. It moves but the building does not.
