Legal Question in Civil Litigation in Georgia

Wage Garnishment Without Notice

This week an auto sales company started garnishing my wages for a repossesion that happened in 1999, but I did not receive any kind of notice that stated that they were going to be garnishing my wages. Also, they previously garnished my wages in 2001, but they had to stop because I changed jobs. I do not recall receiving notice from them about the previous garnishment either.

By law, are they supposed to notify me?

If they are supposed to notify me, can I counter-sue them for not notifying me of the garnishments? Or, is there any legal action that I can take for not receiving notice from them?

Re: Wage Garnishment Without Notice

You are not entitled to any prior notice of a garnishment.

Re: Wage Garnishment Without Notice

There is no advance notification of garnishments. You receive a notification after it is filed. A garnishment happens after you lose a lawsuit. Losing that suit is your notice that further things may happen.
